PRESET PROMO TERM OF SERVICE

These Terms of Service ("Terms") govern your use of the PreSet Promo Shopify app ("the App", "we", "us", "our"), provided by PreTech Park. By installing or using the App, you ("you", "the merchant") agree to these Terms. If you do not agree, please do not install or use the App.

1. What the App does

PreSet Promo helps you run storefront promotions. It lets you create promotional campaigns that display a banner on your storefront and create Shopify automatic discounts on your behalf, along with optional cart incentives such as free-shipping progress bars, gifts with purchase, and tiered discounts. The App works entirely within your Shopify store using Shopify's official tools (App embeds, Admin API, and Shopify Functions).

2. Eligibility and account

  • You must have an active Shopify store and the authority to install apps and manage discounts on it.
  • You are responsible for maintaining the security of your Shopify account. Actions taken through your store's authorized session are treated as taken by you.

3. Free trial, plans, and billing

  • Free trial. The App offers a 14-day free trial. The trial unlocks once your store is on a paid Shopify plan.
  • Subscriptions. After the trial, continued use requires a paid subscription (Core, Power, or Elite). Current prices and features are shown on the App's Plan page and on our website.
  • Billing through Shopify. All charges are billed through Shopify Billing and added to your regular Shopify invoice. We do not see or store your payment card details.
  • Renewal and changes. Subscriptions renew automatically (monthly or annually, as you choose) until cancelled. You can upgrade, downgrade, or cancel at any time from the App's Plan page; changes take effect according to Shopify's billing rules.
  • Cancellation. You may cancel at any time. When you cancel or uninstall, the App's paid features stop and your active campaigns and their discounts are removed from your storefront. Except where required by law, fees already billed are non-refundable; refunds, if any, are handled per Shopify's policies.
  • Price changes. We may change prices for future billing periods. Where required, we will give reasonable notice before a change applies to you.

4. Your responsibilities

Because the App creates real discounts that affect real money, you are responsible for:

  • Configuring campaigns correctly — the discount amounts, dates, targeting, thresholds, and messages you set.
  • Reviewing that campaigns behave as intended, including checking that discounts apply as expected at checkout, especially when you run several promotions at once or alongside your own manual discounts.
  • Complying with all applicable laws for your promotions — including advertising, pricing, consumer-protection, and sales/tax rules in the places you sell.
  • Your store, products, content, and customer communications.

You acknowledge that discount behavior at checkout is ultimately controlled by Shopify's discount and combination rules, and by your store's own configuration (themes, markets, shipping, and other apps).

5. Acceptable use

You agree not to:

  • Use the App for any unlawful, deceptive, or fraudulent purpose;
  • Interfere with, disrupt, or attempt to gain unauthorized access to the App, our systems, or other merchants' data;
  • Reverse engineer, resell, or redistribute the App except as permitted by law;
  • Use the App in a way that violates Shopify's terms, policies, or API rules.

We may suspend or terminate access for violations of these Terms or of Shopify's policies.

6. Discounts and third-party dependencies

The App relies on Shopify's platform (Admin API, Functions, metafields, and App Proxy) and on your theme. While we build the App to be reliable and to fail safely, we do not control Shopify or your theme. As a result:

  • Discount application, banner display, and cart features depend on Shopify's systems and your store's configuration working correctly.
  • Temporary Shopify outages, theme incompatibilities, or configuration conflicts may affect how promotions appear or apply. The App is designed so that such issues degrade safely (for example, a failed banner never breaks your storefront), but we cannot guarantee uninterrupted operation.

7. Intellectual property

The App, its code, design, and content are owned by PreTech Park and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the App for your store while your subscription is active. You retain ownership of your store, your data, and your content.

8. Data and privacy

Your use of the App is also governed by our Privacy Policy, which explains what data the App accesses, how it is used, and how it is protected. By using the App you agree to the practices described there.

9. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free or uninterrupted, or that it will meet every specific requirement of your business. You are responsible for verifying that your promotions run as you intend.

10. Limitation of liability

To the maximum extent permitted by law, PreTech Park will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the App. To the extent liability cannot be excluded, our total liability for any claim relating to the App is limited to the amount you paid us for the App in the three (3) months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

11. Indemnity

You agree to indemnify and hold PreTech Park harmless from claims, damages, and expenses arising out of your promotions, your store, your content, your violation of these Terms, or your violation of any law or third-party right.

12. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access if you breach these Terms or Shopify's policies, or if required to do so. On termination, the App's features stop and its discounts are removed from your storefront; data handling on uninstall is described in the Privacy Policy.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, where appropriate, notify you. Continued use of the App after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws applicable to PreTech Park's place of business, without regard to conflict-of-law principles. (PreTech Park to confirm the specific jurisdiction to name here.)
